Result of the petition for preliminary injunction brought by Immofinanz against CA Immo

The preliminary injunction has been rejected clearly

The Vienna Commercial Court has now responded to the action and petition for preliminary injunction brought by Immofinanz against CA Immo and its subsidiary PHI last Thursday: The preliminary injunction has been rejected clearly. The petition for security, through which  CA Immo and its affiliated companies were to be prohibited from purchasing further shares in Immofinanz and from participating in the extraordinary General Meeting to be held on 17 April 2015 convened by  Immofinanz and exercising its voting rights there, was fully dismissed by the Court for being, inter alia, an abuse of rights.

Dr. Bruno Ettenauer, CEO of CA Immo: "This decision by the Vienna Commercial Court confirms and endorses the course we have taken. We are convinced that the General Meeting will now have no reason to exclude us from the resolution process. Together with our partner O1 Group, we will join the vote on the items of the agenda for the General Meeting, using our stake of approximately 4% in the total share capital of Immofinanz."
